En la mayoría de los casos, no. El procedimiento lo conduce el abogado ante el tribunal, y los herederos firman lo necesario ante un notario o en el consulado de su país de residencia. Si el tribunal llegara a exigir una comparecencia, se lo informo con tiempo suficiente para organizarse.

In most cases, no. The attorney conducts the proceeding before the court, and heirs sign what is needed before a notary or at the consulate in their country of residence. If the court were ever to require an appearance, I let you know well in advance so you can plan.

Mi familiar falleció fuera de Estados Unidos y dejó una cuenta o un inmueble en Florida. ¿Qué procedimiento aplica?My relative died outside the United States and left an account or property in Florida. Which proceeding applies?

Cuando el causante estaba domiciliado fuera de Florida y dejó bienes dentro del estado, lo que suele corresponder es la administración auxiliar, conocida en inglés como ancillary administration. La vía exacta depende del tipo de bien, de su valor y de si existe testamento.

When the decedent was domiciled outside Florida and left assets within the state, the proceeding is usually ancillary administration. The exact route depends on the type of asset, its value, and whether there is a will.

¿Sirve un testamento otorgado en Venezuela o en España?Is a will made in Venezuela or Spain valid here?

Un testamento otorgado en el extranjero puede surtir efecto sobre bienes situados en Florida, pero debe presentarse ante el tribunal debidamente apostillado y traducido.

Hay una excepción importante: Florida no reconoce los testamentos ológrafos, es decir, los escritos de puño y letra sin las formalidades de testigos, aunque sean plenamente válidos en el país donde se otorgaron.

A will executed abroad may take effect over assets located in Florida, but it must be filed with the court duly apostilled and translated.

There is one important exception: Florida does not recognize holographic wills, those written in the testator's own hand without the required witnessing formalities, even where they are fully valid in the country of execution.

Por regla general, no. Las instituciones financieras en Florida exigen cartas de administración u otra orden del tribunal antes de liberar fondos de una persona fallecida.

Hay excepciones: si la cuenta tenía beneficiario designado, o era conjunta con derecho de supervivencia, es posible que no requiera procedimiento sucesorio. Saberlo exige revisar la documentación de apertura de la cuenta.

As a general rule, no. Florida financial institutions require letters of administration or another court order before releasing a deceased person's funds.

There are exceptions: if the account had a designated beneficiary, or was joint with right of survivorship, a probate proceeding may not be needed. Knowing which applies requires reviewing how the account was opened.

It depends on the proceeding. A summary administration can be resolved in a few months; a formal one usually runs longer. Timelines depend on the court, on creditors, and on how long it takes to gather and legalize foreign documentation.

No date can be promised, and you should be wary of anyone who offers you one.

Acta de defunción, testamento si existe, identificación de los herederos y las partidas que acrediten el parentesco. Además, cualquier estado de cuenta, título de propiedad, póliza o certificado que identifique el bien situado en Florida.

Los documentos emitidos en el exterior necesitarán apostilla y traducción, pero eso se gestiona después: para la primera conversación basta con copias simples.

Death certificate, the will if there is one, identification for the heirs, and the records establishing the family relationship. Also any statement, deed, policy or certificate identifying the asset located in Florida.

Documents issued abroad will need an apostille and translation, but that comes later: simple copies are enough for a first conversation.
